IMPORTER SECURITY FILING FACT SHEET

SAFE Port Act of 2006 was enacted by U.S. Congress in October of 2006. This mandated CBP to collect additional entry level data , and require this data prior to loading of ocean vessel cargo in order to improve the targeting process.

Notice of Proposed Rule Making was published on January 2, 2008 further defining the program, the elements to be transmitted, and the specifics. This rule also proposes a new section of the regulations: 19 CFR 149, and amends Several Other Sections of title 19 Code of Federal Regulations.

Interim Final Rule was published November 11, 2008 establishing an effective date and compliance date. The interim rule further defined the elements and filing requirements not issued in the NPRM.

Importer Is Fully Liable and Accountable for the Timely, Accurate and Complete submission of the security filing elements regardless of who provides the elements or transmits the elements.

Effective Date: 01/26/2009 Customs established a delayed enforcement period of one year but is expecting a Good Faith Effort from importers to comply with the interim rule to the extent of their current ability.

•  No Do Not Load Messages (DNL)
•  No Liquidated Damages

Compliance Date: 01/26/2010 Customs will begin implementing enforcement measures. Customs will consider an entity's progress in the implementation of the rule during the delayed enforcement period as a mitigating factor in any enforcement action following the delayed enforcement period.

•  Liquidated Damages of $5000 per violation
•  Do Not Load Messages (DNL)

All Data Elements are to be filed by using current CBP communication methods . These are the Automated Broker Interface (ABI) that is currently used by U.S. Customs Brokers to transmit entry data, and the Automated Manifest System (AMS) that is currently used by carriers, Non Vessel Operating Common Carriers (NVOCC), and some Freight Forwarders to transmit manifest data.

Bill of Lading Required - Commonly known as the 11 th Element. ISF's are done at the "lowest" bill of lading level. CBP will accept an ISF at either the House Bill of Lading Level or regular AMS bill of lading level.

**Absolutely necessary to properly link the Importer Security Filing (ISF) to the customs manifest data**

Bond Required to secure the ISF. An ISF Importer most possess one of the following bonds:

•  Importer Continuous Customs Bond
•  New "ISF" Bond
•  FTZ Operator Bond
•  Basic Custodial Bond
•  International Carrier Bond

Power of Attorney Required to designate an Agent as a Filer.

The Importer Security Filing Data Elements (the 10 portion) to be filed by the party causing goods to arrive within the limits of a port in the United States.

•  Manufacturer (or supplier) name and address
•  Seller name and address
•  Buyer name and address
•  Ship to name and address
•  Container stuffing location
•  Consolidator (stuffer) name and address
•  Importer of record Number
•  Consignee Number (IRS)
•  Country of origin
•  Commodity HTSUS number

The Carrier Security Filing Data Elements (the 2 portion)

•  Vessel Stow Plan - vessel name and operator; voyage number; container operator; equipment number, size and type; stow position; hazmat code; and load/discharge ports

• Container Status Messages - terminal container movements, change in container status , focused on container status messaging set: equipment number; event description, date, time and location; and vessel.
